POP’S sweetheart Taylor Swift is being sued over allegedly stealing Shake It Off from another artist.
According to legal papers, Taylor, nicked lyrics from another unknown song, Haters Gone Hate by Jesse Braham.
The Grammy winning tune was released in 2014 – a year after Jesse released his less successful hit.
In Braham’s song, he sings: “Haters gone hater, playas gone play. Watch out for them fakers, they’ll fake you everyday.”
He claims Calvin Harris’ lady friend blatently ripped off these lyrics and wants a cool $42 million for the alleged theft.
It is the latest legal woe for Pennsylvania-born Taylor, on Wednesday the 25-year-old against a former Denver radio host who sued her after he said he lost his job because of false accusations that he inappropriately touched her during a photo session.
However it looks like this case could be over before it even began as Perez Hilton reports artists can not sue over the use of such a short phrase.
A legal source tells us: “Mr. Braham, who is representing himself, cannot claim copyright protection for the phrases ‘haters gone hate’ and ‘playas gone play’ because the Copyright Act does not protect short phrases and these phrases are not original to him.
“In addition, and most damning to Mr. Braham’s claim, the two songs have absolutely nothing in common.”
In her sexual discrimination case Taylor has asked for a full jury trial and will donate any compensation to charity.
The counterclaim alleges: “Mueller’s newfound claim that he is the ‘wrong guy’ and therefore, his termination from KYGO was unjustified, is specious. Ms Swift knows exactly who committed the assault – it was Mueller.”
The claim adds the Shake If Off hitmaker was “surprised, upset, offended, and alarmed” and he “did not merely brush his hand against Ms. Swift while posing for the photograph. He lifted her skirt and groped her.”
The singer, who is asking for a jury trial, adding that any money she could receive from the lawsuit would be donated to charities “dedicated to protecting women from similar acts of sexual assault and personal disregard.”
Mr Mueller has vehemently denied the claims and is suing the singer over loss of income. – Daily Mirror
