TEMERLOH – The High Court here today dismissed a suit filed by 492 settlers in FELDA Bera against the Federal Land Development Authority (FELDA) and its subsidiary for fraud and breach of trust.
Judge Hassan Abdul Ghani dismissed the suit on grounds that the plaintiffs failed to prove their claims and there was no evidence to support the claims.
He also ordered the plaintiffs to pay RM405,500 in damages to the defendants, whereby 319 of the plaintiffs were required to pay RM1,000 each, while the remaining 173 settlers, who withdrew as plaintiffs in the suit, to pay RM500 each.
The plaintiffs filed the suit in September 2011 claiming that FELDA and FELDA Palm Industries, which were named as defendants, had manipulated the Oil Extraction Rate (OER).
Counsel Datuk Mohd Hafarizam Harun represented FELDA and FELDA Palm Industries while lawyer Sharifah Nur Asmaa’ Syed Azman represented the plaintiffs.- BERNAMA
