KUALA LUMPUR – The mother of actress Ummi Nazeera was acquitted of perjury today, after the prosecution withdrew its appeal against her acquittal.
Deputy public prosecutor Nur Hafizah Rajuni withdrew the appeal against Datuk Maziah Musa’s acquittal when the matter came up for case management before High Court deputy registrar, Ahmad Asyraf Mohamed Kamal.
Nur Hafizah told reporters the prosecution did not intend to proceed with the appeal and that the court had dismissed it.
The prosecution filed an appeal against the decision of the magistrate’s court which acquitted and discharged Maziah of the charge of knowingly giving false testimony in the trial of her divorce at the Federal Territory Syariah Lower Court on Oct 16, 2009, without calling for her defence.
On May 20, 2013, Maziah, 52, was charged in the magistrate’s court for the first time.
However, she was granted a discharge not amounting to an acquittal (DNAA) as several key witnesses could not attend the trial.
Maziah was alleged to have committed the offence using a fake marriage certificate dated Dec 25, 1997, issued by the Islamic Council of Narathiwat, Thailand.
On July 31, 2015, she again faced the same charge but on Oct 19, the same year, Magistrate Nur Azura Murah acquitted her of the charge when the prosecution failed to prove a prima facie case against her.
During the trial, the prosecution called eight witnesses.
Maziah was represented by lawyers Datuk Zainul Rijal Abu Bakar, Mohd Akmal Abu Bakar and Muhammad Zaki Sukery. – BERNAMA
