KOTA KINABALU: The brother of a federal minister has been jailed for five years by the Sessions Court here for shooting a mechanic and injuring him.
Mohd Jusnaidi Omar, 44, also known as Mat Malaya and the brother of Urban Wellbeing, Housing and Local Government Minister Tan Sri Noh Omar, was found guilty Thursday of causing grievous hurt to mechnic Alkarim Atun, 36, using a firearm.
He was accused of committing the offence at an air-conditioning centre at Jalan Tuaran Bypass at about 5pm on May 6, 2015.
Sessions judge Azreena Aziz ruled that Mohd Jusnaidi had failed to cast reasonable doubt in the prosecution’s case during the trial.
She also ordered Mohd Jusnaidi to serve his jail term from the date of his remand last year and denied his application for a stay.
In pressing for a deterrent sentence, DPP Husna Abdul Halim said Mohd Jusnaidi had committed a serious offence under Section 324 of the Penal Code.
“In this case, the weapon involved is a pistol, which is an instrument for shooting and known to be dangerous and could cause death.
“The weapon is not something that is easy available and the accused, being a former member of the Malaysian military, should have known better not to use a pistol without lawful justification,” Husna added.
The court was also told that Alkarim was shot twice on the right leg and had to undergo surgery.
Husna told the court that police only managed to track down Mohd Jusnaidi about a month after the shooting.
Defence counsel Ronny Cham sought a minimum jail sentence for his client, who he said had been released from the main charge under Section 307 of the Penal Code for attempted murder.
