KUALA LUMPUR: The High Court dismissed Sri Muda assemblyman Mat Shuhaimi Shafiei’s bid to challenge the Sedition Act 1948.
Judge Datuk Asmabi Mohamad also ordered Mat Shuhaimi to pay RM2,000 cost to the government, the respondent in Mat Shuhaimi’s civil action against Sections 3 and 4 of the Act.
Section 3 described actions deemed seditious while Section 4 laid down penalties for sedition such as fine up to RM5,000 and maximum jail term of three years.
Earlier, the same court threw out Mat Shuhaimi’s application to stay today’s hearing of his legal challenge against the status of the Act pending his referral of the Act’s constitutionality issue to the Federal Court.
Asmabi said the stay application was an abuse of court process as the same issue has already been dealt with by the Court of Appeal two years ago.
On May 17, 2013, the Court of Appeal ruled that the Act was valid and enforceable.
Mat Shuhaimi is currently facing a sedition charge for allegedly posting seditious material on his blog on Dec 30, 2010.
The offence was purportedly committed at his service centre at 6/2, Jalan Anggerik Vanilla R 31/R, Kota Kemuning, Shah Alam.-NST
