JOHOR BAHRU – Lawyer Kamal Hisham Ja’afar pleaded not guilty in the Sessions Court here today to two more charges of criminal breach of trust (CBT), involving RM216,000.
Kamal Hisham, 45, who was clad in the orange police lock-up uniform, made the plea before judge Mohamad Haldar Abdul Aziz.
On both charges, he was accused, as a director of Southern Ads Sdn Bhd, to have committed CBT by approving payments of RM144,000 and RM72,000 through two RHB Bank Berhad cheques to the legal firm of Messrs. Kamal Hisham & Associates, whereas no payment should be made to the firm.
The offences were allegedly committed at the office of Southern Ads Sdn Bhd, Wisma IBZI, Jalan Damai, Taman Sri Setia here on May 17 and June 4, 2020.
The charge, under Section 409 of the Penal Code, provides an imprisonment for up to 20 years with whipping and fine, if found guilty.
The prosecution, conducted by Johor Prosecution Unit head Saiful Edris Zainuddin and deputy public prosecutor Sulaiman Khoo Kheng Fuei, requested the court to not allow the accused bail as the lawyer was facing six other charges under the Companies Act.
Another was on the tendency that Kamal Hisham would abscond as he had fled the country before.
Mohamad Haldar, however, allowed Kamal Hisham bail of RM200,000 in two sureties on both charges and ordered him to surrender his passport to the court.
Kamal Hisham was also ordered to present himself at the nearest police station once a week pending mention of the case on Sept 30.
