KOTA KINABALU – The High Court here today rejected the application by former Rural and Regional Development Minister Datuk Seri Mohd Shafie Apdal for review of his remand by the Malaysian Anti-Corruption Commission (MACC) under Section 117 of the Criminal Procedure Code.
Justice Ismail Brahim made the decision after hearing submissions by Shafie’s counsel Hamid Ismail and MACC prosecuting officer Rustam Sanip.
Hamid in his submission said MACC had infringed on Shafie’s rights by using Section 117 of the CPC to remand him for their investigation.
However, Rustam countered that MACC had the same jurisdiction as the police to invoke the section.
Counsel said he would file an appeal to the Court of Appeal this week against the high court’s decision. – BERNAMA
