PETALING JAYA – An information technology engineer was fined RM5,000 in default five months in jail by the Magistrate’s Court here today for cruelty to his female Pomeranian dog.
Loo Kah Ann, 28, pleaded guilty to committing the act at Blok C23-13A, Empire Damansara, Damansara Perdana here, at 8.30pm on Aug 17, 2016.
The charge under Section 44(1)(a) of the Animals Act 1953 read together with the Animal Act (Amended) 2013 carries a maximum fine of RM50,000 or imprisonment of up to one year, or both, on conviction.
Magistrate Mohd Azali Ibrahim also issued an order for the dog to be handed over to the Veterinary Services Department.
Earlier, prosecuting officer Mohd Faiz Ajis from the Veterinary Services Department urged the court to impose a sentence “proportional to the accused’s cruel act on his pet”.
In mitigation, Loo, who was unrepresented, said he loved his pet but was angry that it had discharged its urine and faeces indiscriminately.
According to the facts of the case, the dog owner had brought his pet to a veterinary clinic for treatment, and the latter subsequently lodged a report to the department that the animal had been subjected to physical abuse. – BERNAMA
