KUALA LUMPUR: A mother of six and her husband has been fined a total of RM40,000 by the Ampang Sessions Court here for neglecting and abusing her six-year-old son and causing his death.
Sessions Court judge Suraiya Mustafa Kamal handed down the sentence on Nor Zuliana Tahir, 34, and another fine of RM15,000 for her husband Zuhairi Kassim, 40, for abusing his stepson, Muhammad Akhil Mustaqim.
The offences were committed at their home at the Permai Ria apartments in Tasik Permai, Ampang, in May 23, 2014 and May 26, 2014.
Suraiya said the court viewed the offences seriously.
DPP Noor Fadzlin Zawawi requested imprisonment for the couple as a deterrent sentence.
However, defence counsel Ariff Amirul Abdul Jani, who represented both accused, requested for leniency for Zuliana, who is eight months pregnant.
He also requested for a lighter sentence for taxi driver Zuhairi, who is the breadwinner of the family.
The couple has two children from their marriage, while Nor Zuliana has four kids from a previous marriage, including Muhammad Akhil.
The sentence for Nor Zuliana was meted out for offences committed under Section 31(1) of the Child Act and Section 304A of the Penal Code for negligence and child abuse which caused death.
She was fined RM15,000 for the first offence and RM10,000 for the second, in default 15 months and 10 months jail respectively.
Zuhairi was convicted under the same section of the Child Act and will have to pay RM15,000 or spend 15 months in prison if he is unable to pay.
The prosecution will file an appeal against the sentence.
