Consensual Sex With Underage Is Still Rape – Azalina

KUALA LUMPUR – Any person who engages in sex with children below the age of 16 be they consensual or forced is still considered as rape, says Minister in the Prime Minister’s Department Datuk Seri Azalina Othman Said.

She said police would immediately launch investigations on such cases should there be a report lodged on the incident.

“However, it is up to the prosecutor and the statement (given) for the case to be charged in the court,” said Azalina in a statement here today.

The issue on underage marriage became the focus of attention among several members of Parliament during the debate on the Child Sexual Offences Bill 2017 at the Dewan Rakyat sitting here yesterday.

On the question whether the marriage between the rapist and rape victim could get the offender off the hook, Azalina said this was not true.

She said the offender would not get away from punishment as the person could be charged under Section 376(2) of the Penal Code for having sex with those aged below 16.

“The issue should not be spinned by any quarters because it has to be dealt with collectively for the sake of future generations,” said Azalina.

The minister also hoped that the Bill which was passed by the Dewan Rakyat yesterday, could overcome the issue involving the minors. – BERNAMA
