ALOR SETAR – A company director pleaded not guilty in the Sessions Court, here, today to a charge of making a false statement last year.
Mohd Naim Hussain, 59, made the plea after the charge was read to him before judge Azhar Mokhtar.
He is accused of giving the company secretary the authority to make a false statement via Form 49 dated March 2, 2013. The form must be filled as required by Section 141(6) of the Companies Act 1965, in this case, details on the resignation of Shahezan Wali Mohammed, 53, as a company director of MS Saujana Sdn Bhd.
The document was then submitted to the Registrar of Companies on March 18, 2013 although the accused knew the statement was false.
Mohd Naim allegedly committed the offence on March 2, 2013 at ESSTA Management Consultants Sdn Bhd, Suite A, 1018-B, 2nd Floor, Lorong Merpati, here.
Mohd Naim was charged under Section 364(2) of the Companies Act 1965 and if convicted, faces a jail term of up to 10 years or a fine not exceeeding RM250,000, or both.
The prosecution was conducted by Mohamad Azies Han Mohd Fadzil from the Companies Commission of Malaysia while the accused was represented by counsel Shamsul Nizam Sohaimi.
The court fixed Dec 18 for remention of the case and set bail at RM8,000. The accused paid the bail. – BERNAMA
