Rock singer Awie was confident of the authenticity of his marriage certificate throughout his nine years of marriage, a Syariah High Court heard.
He even used the certificate to register the birth of his three children with his wife Rozana Misbun.
His lawyer, Datuk Mohd Zaidi Mohd Zain, argued that Awie had never cheated with regards to the certificate which was always kept in a cupboard in their matrimonial house in Ampang.
“He used the marriage certificate whenever he needs it. He used it to register the birth of each of his children,” Mohd Zaidi told the court.
Awie is asking the court to reject an application by Rozana to set aside a temporary custody order of the couple’s three children granted to him.
Mohd Zaidi argued that it was not fair to allege on the part of Awie, whose real name is Ahmad Azhar Othman, when there was no proof that the certificate was fake during the couple’s marriage.
“He (Awie) was confident that his marriage certificate was genuine,” Mohd Zaidi said, adding that Awie could not dispute on the authenticity of the certificate if proven otherwise by a Penang Islamic Religious Department officer.
He said that the court had to reject Rozana’s application to set aside the temporary custody of the children saying that it has to consider their welfare and safety.
He said another High Court had on July 21 last year issued a temporary custody order to Awie after considering various grounds.
Among the grounds were that Awie claimed that he has proof that Rozana, 37, believed in superstitious practices after finding certain items such as blood, hair, bones in a small bottle, a Buddha statue, a baby’s umbilical cord and an amulet packed in black and yellow clothes.
In the court papers, Awie, who is rock band Wings singer, said that he had married Rozana according to Islamic law in Songkhla, southern Thailand, on June 20, 2005.
They have three children, sons Putra Ahmad Merrah, eight; Putra Ahmad Rezzki, seven and daughter, Puteri Qasseh Antasha, five.
On July 4 last year, Awie claimed trial at a Ampang magistrate’s court to causing grievous hurt on Rozana at their house in Taman Ukay Bistari.-The Star
