KUALA LUMPUR: Former Opposition leader Datuk Seri Anwar Ibrahim will appear in the Syariah Court on July 27 to enable him to officially appoint Syarie counsels to act on his behalf in the case brought against him by Datuk Seri Jamil Khir Baharom and two others.
The Minister in the Prime Minister’s Department, Syarie Prosecution chief Shamsuddin Hussain and Federal Territory Religious Department (Jawi) director Datuk Che Mat Che Ali have filed the application to strike out Anwar qazafâ€™s appeal in the Syariah Court of Appeal.
Anwar’s counsel Kamar Ainiah Kamaruzaman told reporters Monday that the court would issue an Order to Produce (OTP) for Anwar to be brought to court from Sungai Buloh prison on July 27.
The three applicantsâ€™ Syarie counsel Roslizam Rahim said that besides the appointment of Anwarâ€™s counsel, the court had also ordered for Anwar to respond to their affidavit by Aug 28.
Jamil Khir, Shamsuddin and Che Mat made the application to strike out Anwarâ€™s qazaf appeal on May 13, this year.
They filed the matter claiming that Anwarâ€™s application had become academic after he was convicted under Section 377B of the Penal Code and was jailed five years by the Federal Court on Feb 10.
The second reason was that Shamsuddin and Che Mat were no longer related to this case.
They further applied to set aside the notice of appeal by Anwar filed on Apr 23, 2010 against the Syariah High Court decision, which had sought for his former personal aide Mohd Saiful Bukhari Azlan to be prosecuted for qazaf.
On April 14, 2010, the Syariah High Court dismissed Anwarâ€™s application for the prosecution to commence with qazafâ€™s proceedings against Mohd Saiful.
Anwar filed an appeal against the decision on April 23.
